Welcome to FrumTube. These Terms of Service ("Terms") govern your access to and use of the FrumTube platform, including our website, mobile applications, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy.

1. Acceptance of Terms

By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

FrumTube is a community-oriented video sharing platform that allows registered users to upload, view, share, comment on, and interact with video content. Some features (such as uploading or commenting) require an account.

3. Eligibility and User Accounts

  • You must be at least 13 years old to create an account. Users under 18 must have permission from a parent or legal guardian.
  • You must provide accurate, current, and complete information when creating an account, and keep it updated.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You may not impersonate another person, create accounts in violation of these Terms, or share your account with others.
  • We may suspend or terminate accounts that violate these Terms, our Community Guidelines, or applicable law.

4. Sign-In with Third-Party Providers (Google, Apple)

We may offer the option to create an account or sign in using third-party identity providers such as Google or Apple. When you choose to sign in with a third-party provider:

  • We receive only the minimum profile information needed to create or link your FrumTube account (such as your name, email address, profile picture URL, and a stable provider-issued user identifier).
  • We do not access your contacts, calendar, drive files, messages, photos, location, or any other data from those providers beyond your basic profile.
  • Your use of the third-party provider is also subject to that provider's own terms and privacy policies.
  • You may unlink a third-party sign-in method from your FrumTube account at any time through your account settings, or by deleting your FrumTube account.

Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

5. User Content and License

  • You retain ownership of the content you create, upload, or post to the Service ("User Content").
  • By submitting User Content, you grant FrumTube a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as transcoding and thumbnails), display, perform, distribute, and otherwise use that content solely to operate, promote, and improve the Service.
  • You represent and warrant that you own or have all rights necessary to grant this license, and that your User Content does not violate any third-party rights or applicable law.
  • You may delete your User Content at any time; copies retained for a limited period for backup, legal, or safety purposes are described in our Privacy Policy.

6. Prohibited Conduct

You agree not to:

  • Upload content that is illegal, infringing, abusive, harassing, hateful, sexually explicit, or otherwise violates our Community Guidelines.
  • Attempt to gain unauthorized access to the Service, other accounts, or any system or network.
  • Interfere with or disrupt the Service, including via denial-of-service attacks, scraping, automated abuse, or circumvention of rate limits.
  • Misuse any data obtained through the Service, including user contact details, in ways the user has not consented to.

7. Intellectual Property

The Service, including its software, design, trademarks, and original content provided by FrumTube, is protected by intellectual property laws and remains the property of FrumTube or its licensors.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violations of these Terms, our Community Guidelines, or applicable law, or to protect users, the Service, or third parties.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. FrumTube does not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, FrumTube and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless FrumTube and its affiliates from any claims, damages, liabilities, and expenses arising from your User Content, your use of the Service, or your violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York, for any disputes arising out of or relating to these Terms or the Service.
